Longshore and Harbor Workers' Compensation

The law firm of McConnaughhay, Duffy, Coonrod, Pope & Weaver, P.A. also represents employers, insurance carriers, third party administrators, staff leasing companies, and self insured entities in the defense of claims arising under the Longshore and Harbor Workers' Compensation Act (LHWCA, The "Act"). The Act provides compensation and medical care to employees as a result of injuries occurring on the navigable waters of the United States, or in adjoining areas customarily used in loading, unloading, repairing, or building a vessel. The Act also provides benefits to dependents if the injury causes the employee's death.

An example of those covered by the LHWCA are employees in a maritime occupation, including a longshoreman or other person in longshoring operations, and any harbor worker, including a ship repairman, shipbuilder, and shipbreaker.

Given the multi-dimensional aspects of most LHWCA claims, our firm's extensive experience in the areas of state workers' compensation, employment law, and civil law throughout the state of Florida makes the firm uniquely qualified to handle LHWCA claims. Our attorneys are experienced in jurisdictional analysis, investigation analysis, discovery, claims evaluation, and alternative dispute resolution. This, coupled with the firm's multiple locations in or near every major port city in Florida, allows our clients to rest assured their attorneys can and will provide prompt personal attention to any on site discovery, interviews, depositions or conferences which need to take place. Given the high costs facing our clients in LHWCA claims, both from monetary compensation and medical benefits, the attorneys here at McConnaughhay, Duffy, Coonrod, Pope & Weaver, P.A., are able to offer an effective cross-disciplinary approach to the defense of LHWCA claims while, at the same time, minimizing liability in other areas. The attorneys' willingness to pursue all available options will ensure the client a prompt and successful resolution of these claims, including mediation.
