Order of judge requiring that the employer/carrier
provide the claimant with an independent medical
examination at the employer/carrier's expense was not a
departure from the essential requirements of law. The
claimant is not required to exhaust his administrative
remedies in dispute resolution process of the employee
assistance and ombudsman office prior to filing a
request for an IME to be paid by the employer/carrier.
The Florida Workers' Compensation Rules of Appellate
Procedure do not provide for an appeal of a non-final
order. The court in this instance however elected to
treat this appeal as a Petition for Writ of Certiorari.
