JCC erred in awarding PT benefits to claimant because the employer/carrier failed to file a Notice of Denial within 14 days of the filing of a Claim for Benefits. See North River Insurance Company v. Wuelling, 21 FLW D2492. See Also: Commercial Carrier Corp. v. Madsen, 22 FLW D1054 (1st DCA 1997). The JCC has broad discretion in regards to receiving last minute surveillance evidence. However, certain factors must be considered in exercising that discretion. It is error to exclude certain late disclosed evidence in the absence of evidence of actual prejudice to the opposing party.
