Interim Personnel v. Hollis
23 FLW D1888
Claimant's claim for permanent total disability was
premature. The claimant had neither reached maximum
medical improvement nor received 98 weeks of temporary
benefits at the time of the final hearing. In
determining claimant's entitlement to PT benefits, the
employer/carrier challenged the admissibility of
psychiatric testimony. Court determined that there was
no error in accepting psychiatrist's testimony who
conducted portions of his IME examination on two
separate days or in the psychiatrist's relying in part
on tests performed at his direction by a licensed
clinical psychologist. Claimant entitled to temporary
total compensation based upon psychiatric testimony.
