Special Disability Trust Fund v. Collier Enterprises
21 FLW D1499
Claimant and employer/carrier settled case. The joint
petition settlement documents stipulated to a maximum
medical improvement date. More than two years after
the stipulated MMI date, claim was filed by
employer/carrier against the Special Disability Trust
Fund. Section 440.49(2)(g), Florida Statutes (1987),
states that written notice of a claim to the fund must
be made within two years after the date the employee
reached MMI. Because of the fact that the notice of
claim against the fund was not filed within two years
of the stipulated MMI date, court determined that
notice to the fund was untimely and reimbursement from
the fund was denied.
