Congratulations to Angela Flynn on a recent successful result involving a Motion to Enforce Settlement!

The parties attended state mediation and a settlement was reached.  The claimant’s counsel signed the mediation agreement on the claimant’s behalf.  Subsequently, the claimant refused to sign the settlement paperwork. The claimant stated that she was coerced into settlement by her attorney. Ultimately, the claimant admitted that she gave her attorney authority to make a settlement demand prior to mediation as well as authority to accept settlement at mediation and sign the mediation agreement on her behalf. The Judge found that the claimant was not coerced into settlement but was suffering from “buyer’s remorse.” The Judge agreed to enforce the settlement.
