Congratulations to Partner Laura Buck on defending the statute of limitations!

 

This case involved a claimant involved in a work-related motor vehicle accident on 7/28/22.  He last sought medical care in February 2024, at which time he was placed at MMI with a 0% impairment rating and full duty work status.  In May 2025, the Claimant filed the first Petition for Benefits on the claim seeking a follow up with the authorized physician. The Employer/Carrier denied the Petition and the claim on the basis that the Statute of Limitations ran as of February 2025. At the hearing, the Claimant argued that the Employer/Carrier’s agreement in March 2025 to pay an outstanding medical bill, and the fact that there was an outstanding medical bill tolled the statute of limitations. The Employer/Carrier countered that even with the agreement and outstanding bill, the payment of same would not affect the statute of limitations defense because it dates back to the date treatment was provided, or in this case, 7/28/22, as it was the initial hospital visit. The Judge found the Statute of Limitations has run on the claim, and denied the Claimant’s Petition.
