This presented a great opportunity for a Motion for Summary Final Order, as there was no issue, based on the attached medical report, of material fact as to whether the benefit was provided. In this instance, the Claimant’s attorney also failed to respond to the Motion, and the Judge dismissed the Petition in its entirety, including fees and costs. This saved litigation costs associated with defending the PFB, including preparing for and attending mediation.
