Superior Pontiac v. Hearn

458 So.2d 1197, (Fla.App. 1 Dist., Nov 14, 1984)

Claimant injured when tire fell on small finger resulting in permanent physical impairment due to fracture. Medical testimony indicated that the claimant could return to his former employment. Claimant testified that due to continued subjective pain he was unable to perform his former job duties. In addition he sold his tools for the purpose of paying child support. Court determined under these circumstances that claimant was not entitled to temporary partial or wage loss benefits. No objective evidence was introduced to substantiate his claim for these benefits.
