Broward County Sheriff's Office v. Williams

430 So.2d 968, (Fla.App. 1 Dist., May 04, 1983)

Claimant injured in compensable accident and received 30% permanent anatomical impairment. Employer offered job to claimant and treating physician indicated that the claimant could do this work. Claimant did not report to work since he felt he could not do this job offered. Court ruled that this evidence did not support a permanent total finding and held that the claimant's own belief that he would be unable to handle the work offered by the employer is not a substitute for a good faith attempt to actually do the work. DC's finding of PT reversed.PT compensation properly denied when employer offered to reemploy claimant in a position that medical evidence determined he could physically do.
