Gilbarco, Inc. v. LeRoux

All doctors testified that claimant had fully recovered from her injury and was capable of resuming work. Judge determined that claimant had not reached MMI based upon the subjective complaints of pain by claimant. Court determined this to be error. While certain medical conditions are observable by laymen and questions on those conditions answerable by judge based on his observations, the injuries in this case did not fall in this category. Medical testimony was needed and in this instance, it was error to disregard this testimony.
