Conklin v. Cohen
287 So.2d 56, (Fla., Jun 27, 1973)
It is the liability to secure compensation which gives
the employer immunity from suit. The land owner is not
immune from liability unless the owner can be
considered a "contracter" or "statutory employer".
i.e. if the landowner actively participates in the
construction he can be considered an employer immune
from liability. If the architect has a K with the
owner and not the contractor an employee of the
contracter can sue the architect as an independant
contractor. The W/C carrier cannot be liable for
failing to inspect the premises after it has discharged
its duties under the W/C Act.
