International Ship Repair and Marine Services, Inc. v. Emig

Employer filed appeal from non-final order determining
that there was no exclusive remedy in civil action
based upon the exclusive remedy provisions in the
Longshore and Harbor Workers' Act. Court determined
that this was an issue that could be appealed.
Although the employer can file such an appeal denying
immunity under Section 440.11, Florida Statutes, of the
Workers' Compensation Act, such right to an
interlocutory appeal is not restricted to workers'
compensation cases. Accordingly, motion to dismiss
appeal filed by employee denied.
