Commercial Roof Decks v. Flippo

18 FLW D835, March 25, 1993 1st DCA

For purposes of determining date the statute of limitations begins to run and considering the date of last remedial attention, the court determined that it is the date of the last examination of an authorized doctor and not the date the medical bill was paid. There is a line of cases that state that payments made for remedial treatment after the running of the statute of limitations has the effect of reviving the statute. However, in those cases, the actual medical treatment was provided after the expiration of the limitations period. In this instance, the payment of the medical bills was for services provided within the two year statute of limitations. Accordingly, the payment of the medical bill in this case after the statute of limitations had run did not have the effect of reviving the statute.
