Johnson v. Martin Paving

20 FLW D953

Court sustained JCC's determination that the claimant's injuries were personal in nature and unrelated to her employment. Although the appellate court is not disadvantaged in reviewing medical depositions, the resolution of any conflicts therein remains within the fact finding authority of the JCC. The appellate court will defer to the judge's ruling in so far as it is supported by competent and substantial evidence. Such deference encompasses permissible interpretations of the evidence and inferences properly derived therefrom.
