Davis v. Marion County
20 FLW D2131
JCC denied benefits to claimant based on the fact that
the claimant had left a pain management program against
medical advice and without reasonable excuse, prior to
completing the evaluation and necessary testing. Court
deemed this to be in error since there was no showing
that the pain management program evaluation was likely
to bring about an improvement in the claimant's
condition. Even if there had been such a showing, the
failure of the claimant to attend the pain management
treatment is no grounds for denying the claimant
further medical care.
The Judge of Compensation Claims has the authority to
resolve medical conflicts by appointing an independent
medical examination. If the JCC orders one or more
IMEs, she has the authority, after proper notice and a
hearing, to withhold indemnity benefits until claimant
attends the IMEs.
