It is a departure from the essential requirements of
law to allow the employer/carrier to conduct an ex
parte conference with an expert medical advisor. The
records and opinions of treating and examining
physicians and other practitioners can be discussed ex
parte and claimants no longer enjoy the right to be
present during such discussions between the
employer/carrier and those providers. However, once
disputes arise requiring the assistance of expert
medical advisors, ex parte discussions with such
providers are not appropriate.
