An expert medical adviser's opinion is presumed to be
correct and may only be rejected on the basis of clear
and convincing evidence. An expert medical adviser's
opinion has nearly conclusive effect. It creates a
presumption that can be overcome only by evidence of a
quality and character so as to produce in the mind of
the JCC a firm belief or conviction, without hesitancy,
as to the truth of the allegations sought to be
established. Findings made by JCC that expert medical
adviser did not determine for a certainty the diagnosis
of the claimant the first time that he examined the
claimant and the expert medical adviser did not produce
medical literature to support his opinions did not
constitute a basis for rejecting the opinions of the
expert medical adviser.
