Jackson v. Publix Supermarkets, Inc.

Claimant receiving orthopedic care. He requested to be seen by a chiropractor and when the employer/carrier refused he sought such treatment on his own. Court determined that chiropractic care obtained by claimant under these circumstances was authorized. When such chiropractic care is requested the employer/carrier is obligated to either provide chiropractic authorization or obtain a ruling from the deputy that such alternate care was not in the claimant's best interest. The employer/carrier's failure to comply with this obligation made them responsible for the chiropractic treatment sought by the claimant.Court determined that deputy commissioner erred in finding no permanent physical impairment rating warranting the payment of wage loss benefits. Doctor testified that there was no objective evidence of any permanent injuries although he recommended that the claimant be retrained for lighter work and advised that she should avoid heavy lifting and the cold environment of her former employment. The restrictions placed on the claimant by the doctor were inconsistent with the absence of any permanent impairment and negates the deputy's conclusion that there was no permanency.
