Mid-Florida Min. Co. v. Gibson

Court reversed judge's finding of permanent total disability during periods of employment by the claimant. There was no evidence that the work was for a "trial work period" or was the equivalent to sheltered or gratuitous employment.A claimant's testimony as to increased pain and inability to work, absent supporting medical testimony, is insufficient to establish a change in condition warranting a modification of a prior order. The claimant in this instance was also denied temporary total benefits. The claimant was specifically advised by the doctor with disability slips as to the parameters of his temporary total disability and should have known that he was released to return to work in between those times.
