Congratulations to Partner Chris White on a successful MCC defense and reduction of costs!

 

The Claimant brought a claim for injuries to the low back and bilateral hips after bending over to pick up some sunglasses while at work. The claim was litigated heavily through trial with the Employer/Carrier prevailing. The JCC agreed that the accident was not the major contributing cause for the Claimant’s condition and need for treatment, but instead the preexisting injuries. The JCC also found that the Claimant misrepresented the prior complaints in an attempt to obtain workers’ compensation benefits, and the claim was denied on that basis as well. Following the trial, the Employer/Carrier pursued costs against the Claimant. That issue was taken to hearing, and the JCC awarded costs, and the JCC reduced the doctor’s deposition and conference fees down to the hourly rate of $200.00 an hour per the statutory limitations per Chapter 440.13(10) F.S.
