Congratulations to Partner Ryan Davis on defending a claim involving a failure to prove major contributing cause.

 

Approximately 5.5 years after the compensable workplace accident, and 1.5 years after the Claimant sought care for his mental health, the Claimant alleged that his psychiatric condition was compensable. The parties secured IME psychiatrists to support their respective positions on compensability. Following review of the Employer/Carrier’s IME report and the Claimant’s prior medical records, the Claimant’s IME modified his diagnosis to align more so with that of the Employer/Carrier’s IME, while maintaining that the workplace accident caused the condition. Relying on evidence that the Claimant’s condition spanned back nearly 20 years, the JCC ruled that the Claimant had not met the burden of compensability by clear and convincing evidence. Compensability of the psychiatric condition and future need for care were denied.
