Congratulations to Partner Ryan Davis on defending a claim involving the doctrine of res judicata.

After the First DCA vacated an award of compensability under an acute trauma theory, the Claimant attempted to reopen the record and argue a change in circumstances to support a repetitive trauma theory of injury.  The JCC found that this theory and the relief sought were each ripe for adjudication at the original final hearing.  Finding no support for any change in circumstances and no good cause to reopen the record, the JCC denied all requested benefits on the doctrine of res judicata and awarded prevailing party costs to the Employer/Carrier.
