Congratulations to Susan Marks and Tracey Hyde for successfully defending the necessity of ongoing treatment after MMI.

 

Claimant worked as a medical assistant when she fell in a stairwell. After referral to a neurologist for post-concussive issues, the neurologist conducted/ordered several diagnostic tests, all of which her negative. He released her to MMI in 2022 and opined she did not need further medical care related to her injury. Claimant’s IME opined differently, but the JCC accepted the authorized neurologist’s opinion over that of her IME and ruled that Claimant was not entitled to further medical care for her work injury. The 1st DCA issued a per curiam affirmance, upholding the Judge’s order.
