Dismissal of Workers’ Compensation Claim

McConnaughhay, Coonrod, Pope, Weaver & Stern, P.A. attorney Ryan Davis successfully defended this Workers’ Comp matter where the Claimant alleged he suffered a compensable injury when a group of 9-12 unknown men assaulted him with small bats. The Claimant alleged the significant other of a female coworker believed the Claimant and the female coworker to be in a romantic relationship, and the significant other orchestrated the assault. The men saw the Claimant on a smoke break in the Employer’s parking lot and followed the Claimant to a gas station, where the assault occurred.  However, the Claimant was unable to identify any of the assailants or provide any corroborating testimony. Ultimately, the JCC found the Claimant did not meet the burden of establishing a work-caused accident, as the Claimant failed to provide any medical evidence in support of an injury.  Compensability was denied and all claims were dismissed with prejudice.
